Day 8 Testimonies

Chloe Zoeller

Chloe Zoeller was the first witness up for Monday! She testified to how she met Grace and the events that occurred that night. Chloe testified that Grace was intoxicated (not tipsy, as Grace characterized). She also accounts for seeing Grace follow Jonathan as he walked past her without acknowledging or stopping to converse. Chloe testified to Jonathan not appearing abusive to her and how he even thanked her for taking care of Grace, and was taking pictures with onlookers. According to Dani, Chloe testified that she tried to get Grace to go home but eventually invited Grace to the party, to which they had taken the Uber to. As both women sat in the back of the Uber, Chloe, responding to questions from both prosecution and defense, testified to not seeing any injuries, bleeding, nor bruises on Grace Jabbari. Dani notes that she was hugging Grace in the video below:

It’s important to note that Chloe did not see her hand to determine any bruising, swellings, cuts, or injuries. She goes on to testify that they were late to the club and had bought Grace a round of drinks, to which Grace said that it wasn’t strong enough and ordered margaritas and champagne. Relayed by Dani, Chloe testified that she told her that it was Jonathan Majors’ card that was being used to pay for the drinks. After the club, they walked out, and during court, it was made apparent that Grace was taking selfies with Chloe, likely to establish the lack of injuries being seen by others or care by Grace for injuries as it would have been displayed. They went on their way to Lucy’s to likely continue their night and have more drinks. When asked about the hug she was giving to Grace, Chloe testifies to there being no complaints of pain by Grace or transfer any blood onto Grace. Although the objection was sustained (though not stricken from the record), likely due to it being speculative, Chloe testified that when she had seen Jonathan, there were tears on his face (this would likely be the scene on the video). She does not recall Majors yelling. Despite saying she was with her all night, she confesses to not seeing everything Grace done that night, as well as not hearing anything from Chloe after the night of the incident in question!

It must also be noted that Chloe met with the DA twice, once back in April 2023 and last week (likely Friday, 8th December 2023). On redirect, she testifies to not seeing Jabbari’s finger nor did she recall seeing her finger being hit or her head being hit!

Dani believes this was a witness that provided very little and didn’t know much of what went on. He was asked about his intoxication level out of 10, to which he answered 7. He also testified that Jonathan was the one that thanked him for looking after Grace. He described the altercation as seeming like a previous disagreement between Jonathan and Grace. She also relays that he had not spoken to Grace since that night!

Naveed Sarwar

Please note there was a statement submitted to say that the camera was present in the Escalade; however, it did not record, and the SD card was not edited or modified in any way. Naveed Sarwar, the driver, testifies that he has been driving for the car service for 2 years. He says Priya Sadiani (probably Jonathan’s manager at the time according to Dani) was the one that booked the Cadillac Escalade and picked them up around 5 pm. When asked about the interaction between both Grace and Jonathan, he said it was good and that he took them to BAM, Brooklyn Academy of Music. He testifies to neither of them being intoxicated when he was taking them to and from the restaurant. Dani also says that each time they went to a location, he would sit in the car. She also noted that neither the defense nor the prosecutors asked Naveed whether he had used the rearview to observe them as they began arguing. He goes onto testify regarding the moment of the incident, saying that they were arguing, “the girl became very angry,” said Naveed, and he was saying that Jonathan said ‘leave me alone, I want to go,’ that he was not doing anything but she was doing everything. He goes onto say that ‘he remembers Jonathan pushing her back in the car to get away from her, then they both left.’ In reference to Jonathan running away and Grace Jabbari chasing after him. He says that he only recollects Jonathan as he had picked him up last Friday (back in March 2023) and could not remember Grace’s face. On cross-examination, Naveed was only asked two questions, which were whether he saw blood in the Escalade and if he had seen Jonathan sit in the 3rd row of the car the second time he got in. To each of his answers, he said no and does not recall where Majors was sitting when they reentered the car!

Dr. William Chiang

During the direct examination, the prosecutors established that Dr. William Chiang is likely in his sixties, practicing for 33 years since 1984, board certified in emergency room medicine, and has testified as an expert witness over the course of his career. He is also a toxicology expert who has written numerous articles on substance abuse. He testified regarding the tests that were conducted with Grace. X-rays were conducted. He says that there was a “fine hairline fracture” on her finger. He goes on to testify that her injuries were consistent with what she had described, and the ear injury would have come from a fight or a sharp object that somehow made it behind the crease of her ear. On cross-examination, he admitted to not knowing how she got hurt, how her finger and her ear were hurt, saying that she herself did not know the answers to these questions that were posed. Basically, while in the hospital, she kept saying I don’t know. He testifies to the injury on her finger being inconsistent with the finger being twisted and goes on to add it’s not consistent and unlikely that her whole hand had been squeezed, as it’s difficult to sustain a fracture that was reflected in the X-rays from the hand being squeezed and firmly established that there was no isolated bruising. Defense grilled further by asking the hypothetical of if she was hit in the back of the ear, which caused this supposed injury, wouldn’t there be bruising around the ear? To which, the doctor responds with yes. Dani pontificates on this response by adding that ‘who would cause damage with such precision to the ear as Grace described without surrounding damage.’ The doctor added that it would take substantial pulling or force to cause that injury that’s been sustained.

On redirect, it was asked whether her head, neck, and abdomen were examined, to which the doctor answered yes but said he had no recollection of the encounter. The clinical exam determined that she was not hit in the head. He also let the court know that when an individual scores 4 or more on the Audit C exam, that a referral would have been given, but they didn’t on this occasion. He goes onto testify that she was not clinically intoxicated using the example of driving while intoxicated but under a certain limit.

On recross, the defense returned and showed page 4 of the emergency medical report, and the doctor was asked if the ear injury was consistent with being hit in the back of the head, to which he responded that ‘it would be inconsistent.’ And there was no medical exam to corroborate being struck in the back of the head as testified to by Grace Jabbari.

It was established at Bellevue that she was an alcoholic. Before two Audit C screening tests were conducted, which are done to determine whether a patient has an alcohol disorder, Grace had already told the staff at the hospital that she had consumed five to six glasses of wine. The first test was conducted at 4:05 pm, and the other at 4:43 pm. She also told the conductor of the test that two to three times a month, she had consumed six or more drinks. The scoring for Audit C is on a numeric scale, and for women, any score of 3 or more is positive for hazardous drinking or alcohol abuse disorder. Based on her answers, Grace Jabbari scored a 5, meaning she allegedly has a drinking disorder. The defense has been trying to establish this since their cross-examination of Grace.

No videos of the chase, surveillance with Grace was shown to the doctor, only pictures of her injuries taken by the police and selfies with her friends were shown to Dr. Chiang.

Day 9 Testimonies

The Officers’ Testimonies

Officer Eric Lusero had moved from NYPD to Suffolk County Long Island and was largely unhelpful according to Dani and didn’t provide anything than “I do not recall.”

Officer Brian Hanson, a 21-year-old vet and recently made sergeant in July 2021, was the one that made the arrest.

Officer Swayne, he was domestic violence trained and was the one that Grace had told that Jonathan had choked her. However, in her direct and back in March 2023, she had claimed she was not strangled; subsequently, the strangulation charges were dropped.
